1. Introduction & Company Information
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client", "User", "you") and PilatesCOREuk Ltd ("Company", "we", "us", "our"), registered in England and Wales. These Terms govern your access to and use of backtoyou.pilatescoreuk.com, our free educational resources, the 30-Minute Back Pain Breakthrough Consultations, and the 6-Week "Back to You" spinal coaching programme led by Kim Karlsson.
By using our website, submitting an inquiry form, or booking a consultation, you confirm that you have read, understood, and agree to be bound by these Terms.
2. Scope of Services & Clinical Boundaries
PilatesCOREuk Ltd provides specialized postural re-education, Level 4 back rehabilitation coaching, and clinical Pilates movement therapy designed to help busy individuals rebuild spinal stability and reduce chronic muscular tension.
- Professional Scope: Kim Karlsson is a certified Level 4 Low Back Pain Rehabilitation Specialist and Clinical Pilates Instructor. She is not a medical doctor, orthopaedic surgeon, or chartered physiotherapist.
- Non-Medical Nature: The information, exercise routines, biomechanical tips, and video tutorials provided through our services are educational and physical conditioning in nature. They do not constitute a medical diagnosis, treatment plan, or medical clearance.
- Physician Consultation: You must consult your GP, spinal specialist, or qualified medical doctor before commencing any physical rehabilitation regimen, particularly if you have a documented history of spinal pathology (such as disc prolapse, spondylolisthesis, or spinal canal stenosis).
3. Clinical Screening & Admission Policy ("Who We Accept & Who We Turn Away")
Because back pain is complex and safety is our highest priority, we do not accept every applicant who applies for our programme:
- Compulsory Triage: Every applicant undergoes a comprehensive clinical screening through our discovery questionnaire and 30-minute consultation before enrolment is offered.
- Right of Refusal / Referral Out: If Kim Karlsson identifies red flag spinal symptoms (e.g., bilateral radiculopathy, sudden motor deficits, saddle anaesthesia, bladder/bowel dysfunction), severe structural instability, or unmanaged systemic conditions requiring surgical or emergency hospital care, we will decline enrolment and advise immediate consultation with an appropriate NHS or private medical specialist.
- Duty of Care: Our refusal to accept an applicant is based strictly upon our professional duty of care and clinical scope of practice.
4. Free 30-Minute Discovery Consultations
We provide complimentary 30-minute discovery consultations to assess suitability:
- Punctuality & Commitment: Appointment slots are strictly limited each week. You agree to arrive on time and complete all preliminary intake questions honestly.
- Cancellations & Rescheduling: If you need to reschedule, you must provide at least 24 hours' notice via email (kim@pilatescoreuk.com) or your booking confirmation link. Failure to attend without prior notice may disqualify you from future complimentary consultations.
5. Programme Enrolment, Fees & Payments
For clients accepted into the 6-Week "Back to You" Programme:
- Fees: All programme fees will be clearly communicated during your consultation prior to any financial commitment. All fees are in GBP (£) unless explicitly stated otherwise.
- Payment Terms: Programme fees must be paid in advance via our authorized secure payment gateway. Where installment plans are agreed, you remain contractually liable for all installments until the total agreed programme fee is satisfied.
- Cancellation & Cooling-Off Rights: Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a statutory right to cancel within 14 days of purchase. However, if you request immediate access to digital video materials, personal coaching calls, or customised movement plans during this 14-day period, you acknowledge that you waive your statutory right of cancellation for services already rendered.
6. Results, Commitments & Client Responsibility
Physical rehabilitation requires consistent personal execution and adherence to coaching guidelines:
- No Guarantee of Specific Results: While our methods are rooted in Level 4 evidence-based low back pain management protocols, human anatomy and spinal pathology vary enormously. We do not and cannot guarantee specific pain eradication or physical outcomes.
- Adherence: Your progress relies upon your active participation, consistency in performing gentle daily homework routines, attending scheduled coaching sessions, and observing safe movement principles in everyday life.
7. Intellectual Property Rights
All materials produced by PilatesCOREuk Ltd—including but not limited to video routines, audio coaching, digital PDFs, exercise guides, diagrams, website copy, logos, and branding—are the exclusive intellectual property of PilatesCOREuk Ltd and Kim Karlsson, protected by UK and international copyright laws.
- You are granted a personal, non-transferable, revocable licence to view and use materials solely for your own individual rehabilitation.
- You may not copy, reproduce, distribute, resell, upload, or share our proprietary materials with any third party or use them for commercial coaching without express written permission.
8. Limitation of Liability
To the fullest extent permitted by English law:
- PilatesCOREuk Ltd and Kim Karlsson shall not be liable for any indirect, incidental, special, or consequential damages resulting from your participation in our exercises or use of our website.
- You undertake all physical exercises voluntarily and assume all associated physical risks. You agree to stop exercising immediately and seek medical attention if you experience acute, sharp, or escalating pain during any movement.
- Nothing in these Terms limits or excludes our liability for death or personal injury caused by our proven negligence, fraud, or any liability which cannot be lawfully excluded under the laws of England and Wales.
9. Governing Law & Dispute Resolution
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute.
